Missouri's statutes of limitation for medical malpractice claims require that a claim must be filed within two years of the incident, or within three years of death for a wrongful death claim.

Missouri law also requires that the plaintiff's attorney produce a medical expert witness to support the validity of the malpractice claim within 90 days of filing. In other words, the burden of proof is on the victim of negligence or malpractice to show that the claim is legitimate.
